Program Council meeting scheduled for 09 September 2008
The next meeting of the Program Council has been scheduled for September 09. The
agenda includes continued discussion on the role of the so called compensation firms
in asserting insurance claims. The Council has invited representatives of insurers
and compensation firms to provide their stance on the issue.

Program Council meeting of June 02
In the Association’s office on June 02, the Program Council held a meeting devoted
to the operation of compensation firms, with guests from the Competition and Consumer
Protection Office UOKiK, insurer PZU SA and Generali. The UOKiK reported on the
Office’s activities concerning the examination of agreement forms used by compensation
firms and presented the most common irregularities. The representatives of insurance
companies discussed their experiences with the observed scale and specific activities
of compensation firms in the context of current and new claims handling systems.

General Assembly of Members of May 15
On May 15, 2008 the Association held a General Assembly of Members summarizing the
year 2007, especially in terms of approval of the essential yearly reporting. The
Assembly also approached some current organizational and statutory issues of the
Association.

Meeting of the Association’s Management Board of April 21
On April 21, 2008 Pro Motor’s Management Board held a meeting devoted to current
affairs and acceptance of new members. The Board discussed further statutory actions
taken esp. in the legislative area, as well as preparation of the annual General
Assembly of Members to be held in May.

Program Council meeting of April 14
In the office of the Association on April 14, 2008 the Program Council held a meeting
together with the representatives of the Polish Chamber of Insurance PIU, Ministry
of Finance, Insurance Ombudsman and Insurance Advice Bureau.
The chief topic was the operation of the so called compensation firms. Participants
to the discussion raised the following aspects of intermediation in asserting insurance
claims:
- Asserting insurance claims compared to other financial services,
- Compensation firms in the context of legal assistance provided by legal counsels
and lawyers (accessibility),
- Activities of compensation firms classified as insurance mediation (brokerage),
- Reasons for increased demand for the services provided by compensation firms,
- Organization and standardization of the activities of compensation firms, methods
of operation,
- International experiences,
- Possible legislative initiatives, e.g. bringing the activities of compensation firms
under administrative regulation to a certain extent,
- Activities increasing insurance awareness of customers, education,
- Activities of insurance companies towards development and improvement on the quality
of claims handling.
Council Chairman prof. J. Monkiewicz concluded that in the light of analyses carried
out by the Association the current knowledge concerning the discussed issue does
not give sufficient grounds for radical action, both in terms of practice and legislation.
The Association is planning to continue the project, with statistical information
being collected, which will allow determining (projecting) the scope of irregularities.
Broadcast by the media, it is the irregularities that impact the perception of the
issue. The aim is therefore to ensure professional assistance to the recipients
of insurance services and to create a legal and practical framework for the functioning
of such assistance. The Chairman stressed the fact that cooperation of many institutions
and the Association’s readiness to coordinate such cooperation is essential. What
is also needed is urgent preparation of a better diagnosis, which cannot be developed
without a more comprehensive empirical study. Data bases held by the Polish Chamber
of Insurance, Insurance Ombudsman and the Financial Supervision Authority KNF are
of particular significance. It is vital that the compensation firms themselves also
cooperate and that their best practices are promoted. The Chairman suggested inviting
the representatives of the KNF and Consumer and Competition Protection Authority
UOKIK to the next Council meeting.

Program Council meeting of February 25
The Program Council held a meeting on February 25, 2008. Discussion focused on legislation
issues relating to the Association’s activities. Legislative work concentrates on
amendments to current regulations on compulsory insurance which raise important
issues influencing the condition of the market and its proper functioning, amendments
to the law aiming to eliminate the current doubtful interpretations, and development
of comprehensive solutions and changes to „cleanse” the current law. The Council
accepted the scope of regulations to be presented as the Association’s initiatives
to respective authorities, including in particular the application of the so called
prolongation clause, VAT, bonus/malus system and alternative allocation of registration
fee introduced in 2003 and paid towards the Central Register of Vehicles and Drivers
CEPiK.

Management Board meeting of February 04
On February 04, 2008 the Management Board of Pro Motor held a meeting devoted to
its initiative to amend the current regulations on compulsory insurances. The discussion
focused on the following issues:
- Cross-border traffic, vehicle registration and insurance coverage,
- Insurance offer and obligation to take out insurance, beginning of liability period,
- Insurer’s right to cancel a contract (withdraw from a contract) in the case of notorious
evasion of premium or installment payment,
- Cancellation of the prolongation clause where vehicle ownership changes or vehicle
is otherwise transferred from the insuring person to (new) owner,
- Exclusion of liability (joint ownership and liability against third parties),
- Temporary withdrawal from traffic in the context of insurance price,
- VAT,
- Obligation to provide information on insurance history and basis for price increases
or reductions,
- MTPL contract documentation in direct channel sales.

General Assembly of Members
On November 27, 2007 the General Assembly of Members gathered to discuss the Association’s
organizational and statutory affairs. The Assembly defined the value and rules for
payment of membership fees, adopted regulations for the General Assembly of Members,
Program Council, Commission of Inspection, and the Management Board. The Assembly
resolved on the Association’s program and approved the activity plan of the Association
for 2008.

Management Board meeting of November 14, 2007
In the office of the Association on November 14, 2007, the Management Board held
its second meeting. The Board adopted the Association’s activity plan for 2008 and
determined the rules for payment of membership fees.
The Management Board summarized program efforts so far and considered the Council’s
objectives for the activity plan to be approved by the General Assembly of Members.
Board members summarized the current statutory activities in the context of present
and expected market changes. They agreed to intensify the current communication
with state authorities, market entities and the press.
The Board also discussed the meeting of the Board with Stanisław Kluza, Chairman
of the Financial Supervision Authority KNF, as well as the Association’s proposals
to amend respective regulations to allow the introduction of a modern bonus-malus
system and establish an insurance price growth index (under working name Pro Motor
Index).

Management Board meeting of October 11, 2007
On October 11, 2007 the Management Board of Pro Motor held its first meeting. The
meeting was devoted to organizational issues related to registration in the court
register KRS, work on the activity plan for 2007 and 2008, and preparation of the
General Assembly of Members, which will approve the Association’s internal documentation
and define membership fees.

Program of the Association underway
On September 14, 2007 members of the Program Council held a meeting, in the course
of which the Council identified key areas of the Association’s future activity:
- Claims handling,
- Legislation (on insurance, esp. MTPL and legal environment – traffic code),
- Training,
- Organization of annual international conference, detailed topics being mutual claims
handling, press workshops for journalists involved in motor and insurance subjects.
According to the Council, the above proposals should be included in the Association’s
activity program. The Council will recommend such objectives to the General Assembly
of Members as they are a result of the Association’s intention to be active both
in the insurance sector and the legal environment in which it is embedded (traffic
law). The objectives are in line with the Association’s mission statement, which
is to improve regulations both for insurers and clients, apply better claims handling
procedures (allowing price reduction), and safeguard the interests of clients.
